Photoshoot Terms & Conditions
1. Eligibility:
Entry is open to verified customers of Mermaid Cosmetics who have submitted a valid email address and purchase order number. Participants must be at least 18 years of age.
2. Entry:
Multiple entries are allowed. Each valid purchase order submitted counts as one entry. Entries must be submitted through the official Mermaid Cosmetics website form.
3. Selection of Participant:
One participant will be selected at the sole discretion of Mermaid Cosmetics to feature in the campaign photoshoot. The decision of Mermaid Cosmetics is final and binding. No correspondence will be entered into.
4. Photoshoot Participation:
By entering, the participant agrees to attend and participate in the photoshoot on the date(s), time(s), and location(s) determined by Mermaid Cosmetics. Mermaid Cosmetics reserves the right to reschedule, relocate, modify, or cancel the photoshoot at its sole discretion.
All costs and expenses associated with participation in the photoshoot are the sole responsibility of the selected participant, including but not limited to travel, transportation, accommodation, meals, and any other personal expenses. Mermaid Cosmetics will provide styling, makeup, and grooming services for the photoshoot only. No other costs or reimbursements will be covered unless expressly agreed in writing at the sole discretion of Mermaid Cosmetics.
All creative direction, including but not limited to styling, wardrobe selection, makeup, grooming, photography style, poses, image editing, and final content selection, shall be determined exclusively by Mermaid Cosmetics. The selected participant acknowledges and agrees that all creative decisions are final and may not be challenged, altered, or disputed.
5. Ownership & Usage Rights:
All photographs, videos, and related content captured during the photoshoot shall remain the exclusive property of Mermaid Cosmetics. By participating, the participant assigns all rights, title, and interest in the content to Mermaid Cosmetics, including rights to reproduce, edit, distribute, display, or use the content in any media worldwide, without additional compensation.
6. Consent & Waiver:
Participants acknowledge and agree that they will not make any claims, demands, or take legal action against Mermaid Cosmetics or its affiliates regarding the photoshoot, use of images, or any related activity. Participants waive any moral rights, copyright claims, or other rights to the content.
7. Confidentiality & Conduct:
Participants agree to conduct themselves professionally during the photoshoot. Any breach of conduct or violation of Mermaid Cosmetics’ guidelines may result in disqualification and removal of content rights.
8. Liability:
Mermaid Cosmetics is not responsible for any loss, damage, or injury that may occur during participation in the photoshoot. Participation is voluntary.
9.Modification & Termination:
Mermaid Cosmetics reserves the right to amend, suspend, or terminate the challenge, photoshoot, or terms at any time without prior notice.
10. Governing Law:
These terms shall be governed by and construed in accordance with the laws of the state of New South Wales, Australia. Participants agree that any disputes will be resolved exclusively under the jurisdiction of the courts of New South Wales.
